Personal Information Collection Statement
The personal data collected in this Form may be used by CTF Jewellery Academy Company Limited (operating under the name of Loupe) ("Loupe") to provide you with services, process your membership application and to administer and manage the Loupe Programme. Any reference in this Form to "we", "us" and "our" is a reference to Loupe.
Your personal data may be used for the following purposes:
(a)to offer you with our products and services, including sending you marketing and promotional materials, event information and e-shopping items relating to our products and services;
(b)to conduct joint promotion events including notifying you of sales and marketing offers and sending you sales and marketing materials relating to the promotional offers or events of our affiliated, associated, related, subsidiary companies and/or companies under the common control of our ultimate holding company ("Group Companies") and independent commercial entities (together with Group Companies, the "Business Partners"), which may be located outside Hong Kong, in relation to the following products, services and/or businesses:
(i) banking;
(ii) telecommunications;
(iii) beauty salons;
(iv) electronic goods;
(v) food & wine;
(vi) entertainment, including cinemas, theme parks and karaokes;

(g) to perform research or statistical analysis in order to improve our goods and services and for sales and marketing purposes;
(h) to verify your identity and your eligibility to participate in our programmes;
(i) to obtain statistics about users of our Website to analyse site usage in order to help its further development;
(j) to provide you with a log-in ID for our Website; and
(k) to make such disclosures as required by law.
Personal data collected in this Form is required in order for us to process your membership application and to administer and manage the Loupe Programme. You do not have to provide this personal data to us, but if you choose not to, we will not be able to process your membership application.
We do not sell, rent or trade your personal data to or with third parties including our Business Partners. However, your personal data may be disclosed or transferred by us to the third parties described below:
i.third party suppliers of goods and services (whether in Hong Kong or abroad) engaged by us to assist with providing you our services (including marketing analysis and research, data entry, management of our customer database, distribution of our sales and marketing materials, products rewards, vouchers and customer service);
ii. for the purposes specified above, we may share with or transfer your personal data to the Business Partners, provided that the data user or the transferee are under a duty of confidentiality and contractually bound to use your personal data substantially in accordance with our Privacy Statement, otherwise, we will not transfer any data;
iii. in the event of a company reorganisation, merger, acquisition, sale or transfer, your personal data will be transferred to such third parties and/ or transferees in such circumstances in order to continue to provide you the relevant services; and
iv. competent court of law, law enforcement agencies and/or regulatory bodies for compliance with applicable laws and regulations and protection of our legal rights.

We at CTF Jewellery Academy Company Limited (operating under the name of Loupe)("Loupe") and our parent, subsidiary and/or affiliated companies within the Loupe group of companies (together the "Affiliates") value your personal data and privacy very highly. We know how important it is to protect your personal data. We pledge to comply with the requirements of all applicable personal data and privacy protection laws and regulations in relation to personal data protection.
Any reference in these terms to "we", "us" and "our" is a reference to Loupe and our Affiliates. Please read this Privacy Statement carefully to understand how we will handle your personal data.
Unless your express consent is required by applicable law, by providing us with your personal data (including by registering for membership of any of our customer or sales and marketing programmes owned, managed and/or controlled by us, registering to attend any of our events, participating in our interactive services or in any way communicating with us), you are accepting the terms of this Privacy Statement and consenting to our collection, retention, disclosure and use of your personal data, including transfer of your personal data overseas, as specified in this Privacy Statement. Further, we will only use and transfer your data for direct marketing purposes as specified in this Privacy Statement.
In the event of any discrepancy or inconsistency between the English and other local language versions of the Privacy Statement, the English version will prevail.
1.How do we collect personal data and what do we collect?
(i)Sources of personal data
The types of personal data that we collect will depend on the nature of your dealings with us. We may collect personal data from you by the following channels:
a.when you register for membership of any of our customer or sales and marketing programmes owned, managed and/or controlled by us;
b.when you register to use, or enter information into, any of our interactive services (for example, our blogs and forums);
c.when you register to attend any of our events, workshops or seminars;
d.when you purchase goods and services from us or use services or products offered by us;
e.when you correspond with us; and
f.when you use our website www.loupe.com.hk ("Corporate Website"), other websites operated by our Affiliates ("Affiliates Website" and, together with the Corporate Website, the "Website") or our official page on social media sites.

We may collect from you the following information which may contain personal data as defined under applicable data protection laws and regulations:
a.account registration information, including your name, gender, date and month of birth, age group, title, contact numbers (telephone, fax, mobile), postal address and email address;b.billing information, transaction and credit card information (if you make a purchase from us);
c.shipping information (if you make a purchase from us);
d.records of correspondence between you and us; and

As noted above, we may, from time to time, send you sales and marketing materials and information regarding our or our Business Partners' products and services as stated in paragraphs 2(a) & (b) based on your name and contact details that you have provided to us. However, we will not use your personal data unless we have received your consent. Suitable measures are implemented to make available to you the option to "opt-out" or "opt-in" as required by applicable law of receiving such sales and marketing materials at the time you provide us with your personal data.
Please note that you can object to such use of your personal data at any time. If you do not want us to retain your personal data for this purpose, you should do so by choosing the "opt-out" option in the relevant membership subscription or registration form, or by choosing to unsubscribe from any marketing email we have sent to you, or by emailing us at enquiry@loupe.com.hk, specifying that you wish to "opt-out".
4.Will your personal data be given to other persons?
We do not sell, rent or trade your personal data to or with third parties including our Business Partners. However, your personal data may be disclosed or transferred by us to the third parties described below:
a.third party suppliers of goods and services (whether in your jurisdiction or abroad) engaged by us to assist with providing you our services (including marketing analysis and research, data entry, management of our customer database, distribution of our sales and marketing materials, products rewards, vouchers and customer service) ("Third Party Service Providers"). Our Third Party Service Providers are under a duty of confidentiality and contractually bound to use your personal data in connection with the purposes specified at paragraph 2 above, and not for their own purposes (including direct marketing); and
b.for the purposes specified at paragraph 2 above, we may share with or transfer your personal data to the Business Partners, provided that the data user or the transferee are under a duty of confidentiality and contractually bound to use your personal data substantially in accordance with this Privacy Statement, otherwise, we will not transfer any data;
c.in the event of a company reorganisation, merger, acquisition, sale or transfer, your personal data will be transferred to such third parties and/ or transferees in such circumstances in order to continue to provide you the relevant services; and
d.competent court of law, law enforcement agencies and/or regulatory bodies for compliance with applicable laws and regulations and protection of our legal rights.
5.Retention of your personal data
We will not keep personal data longer than is legally permitted pursuant to applicable data protection laws and regulations. We will purge unnecessary personal data from our system in accordance with our internal procedures.

Protection of your personal data collected is a priority for us. We will always strive to ensure that your personal data will be protected against unauthorised access. We are based in Hong Kong. Your personal data may be accessed by us or transferred by us to and accessed by the third parties listed in paragraph 4, in Hong Kong or elsewhere in the world. Such personal data are only accessible by us or the personnel of the third parties listed in paragraph 4 for the purposes listed in paragraph 2, who will be instructed to observe confidentiality duty and the terms of this Privacy Statement when accessing such personal data. LOUPE Membership Program Terms and Conditions
These terms and conditions apply to the LOUPE Membership Programme in Hong Kong ("Programme"). It is the responsibility of any person applying to be a member ("Applicant") and each member of the Programme ("Member") to read and understand them.
These terms and conditions must be read in conjunction with any other terms and conditions set out in any Programme handbook and the Programme website ("Website") and other documents as provided by CTF Jewellery Academy Company Limited (operating under the name of LOUPE) and/or its subsidiaries or affiliates (collectively, “LOUPE”) from time to time (together, including these terms and conditions, the "Terms").
By submitting a completed Application Form or otherwise becoming a Member, an Applicant acknowledges that he/she has read, understood and agrees to comply with all of the Terms.
1. Overview of the Programme and general terms and conditions
1.1 The Programme is offered and managed by LOUPE.
1.2 Without limiting LOUPE‘s rights under the Terms, in particular its rights of suspension and termination, Members must comply with all of the Terms in order to maintain their memberships and enjoy the benefits and privileges granted to Members.
1.3 LOUPE reserves the right to amend, supplement or otherwise revise the Terms at any time without any prior notice to Members. In the event of any inconsistencies between the Terms, the terms and conditions as set out on the Website will prevail, unless specifically stated otherwise. Use of the Website is further subject to the legal and privacy terms found on the Website.
1.4 Membership is not transferable and may only be used by the named Member. Misuse of Programme benefits and privileges may result in the suspension or termination of membership or the withdrawal or forfeiture of benefits and privileges (including accrued benefits and rewards).
1.5 Members are required to inform LOUPE of any change in personal particulars as soon as reasonably practicable by emailing enquiry@ loupe.com.hk or such email address as advised by LOUPE from time to time.
1.6 Programme membership and information relating to membership will be kept in LOUPE's records and such records will be conclusive evidence and the sole basis for the calculation and determination of all Member benefits and privileges.
1.7 In the event of any dispute arising out of or relating to the Programme or individual membership, LOUPE reserves the right to make sole and final decisions.
2. Eligibility for membership and applications
2.1 Membership in the Programme is for individual, natural persons only. Joint or duplicate applications, or applications made by or on behalf of any companies, corporations, partnerships, businesses, legal entities or other organizations will not be accepted.
2.2 To apply for membership, the Applicant must complete and sign the Application Form available at LOUPE store at PMQ, 35 Aberdeen Street, Central, Hong Kong or through on-line application at the website of www.loupe.com.hk.
2.3 Members are eligible for enjoying the benefits of the Programme, including but not limited to attending workshops or seminars organized by LOUPE and purchasing goods or services offered by LOUPE.
2.4 LOUPE reserves the right not to consider or process any incomplete or/and incorrect Application Form.
2.5 LOUPE has the sole and final right to approve or reject any membership application regardless of whether an Applicant has met any or all of the criteria for membership.
3. Membership termination and suspension
3.1 LOUPE makes no warranty or representation as to the availability of the Programme or its duration or continuity and may, in its absolute discretion, suspend or terminate the Programme and/or any membership at any time without any liability arising by reason of such action.
3.2 LOUPE may, in its sole discretion, immediately without notice suspend or terminate the membership of any Member who fails to comply with the Terms. Upon the termination of any membership, all benefits and privileges accrued under the membership shall be cancelled and be null and void.
4. Member obligations and warranties
4.1 Members must not:
i) act in any way in breach of the Terms; or
ii) abuse or misuse the Programme, or any of their benefits or privileges offered or gained under the Programme, including: (a) engaging in illegal or fraudulent activities;
(b) supplying or attempting to supply false or misleading information; (c) making
a misrepresentation to LOUPE or any of its subsidiaries or affiliated companies; or (d) selling, assigning or transferring, or offering to sell, assign or transfer, any benefit or privilege of the Programme.
4.2 By submitting an application, each Member and Applicant represents, warrants and undertakes to LOUPE that:
i) the Member or Applicant has provided, or will provide, as and when required by the Terms, to LOUPE all information and details required by the Terms and by LOUPE in its discretion for the purposes of offering and maintaining the Programme;
ii) all information and details provided by the Member or Applicant and held by LOUPE is and will at all times, be correct, complete and current (unless an application is rejected, in which case the obligation to update information and details ceases); and
iii) the Member or Applicant has read, understood, will comply with, and has the power and authority and legal right to agree to, all of the Terms.
5. Liability and warranties
5.1 Except as otherwise expressly provided in the Terms and to the greatest extent permitted by law, LOUPE is not liable (and excludes all liability) for any loss, damages or claims of any kind arising under, pursuant to or in connection with the Programme, including all:
i) direct, special, indirect, consequential, incidental or punitive damages; and
ii) damages for economic loss, loss of profits, loss of revenue, loss of goodwill, loss of bargain or opportunity, loss of anticipated savings or loss or corruption of data, whether in contract, tort (including without limitation negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.
5.2 Subject to section 5.3, any express or implied warranties, representations and statements given or made by LOUPE which relate to the Terms or their subject matter, and which are not specifically contained in the Terms, are excluded and disclaimed to the maximum extent permitted by law.
5.3 Nothing in the Terms excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified. If any condition or warranty is implied into the Terms under any law and cannot be excluded, and LOUPE is able to limit, restrict or modify the Member's remedy for a breach of such a condition or warranty, then LOUPE’s liability for breach of the condition or warranty is limited to the maximum extent permitted by law and LOUPE may, in its discretion, elect between any options available to LOUPE to remedy the breach of such a condition or warranty.
6. Personal data
LOUPE will collect, use, disclose or transfer a Members' personal data in accordance with the Privacy Statement published on its website at www.LOUPE.com.hk.

Any questions regarding the Programme can be directed to LOUPE using the contact details set out below, as may be amended by LOUPE from time to time by notification to Members or by posting revised details on the Website.

8. Jurisdiction
The Terms are governed by the laws of Hong Kong and each party hereby irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong.
