    Personal data collected in this Form is required in order for us to process your membership application and to administer and manage the Loupe Programme. You do not have to provide this personal data to us, but if you choose not to, we will not be able to process your membership application.

      i.third party suppliers of goods and services (whether in Hong Kong or abroad) engaged by us to assist with providing you our services (including marketing analysis and research, data entry, management of our customer database, distribution of our sales and marketing materials, products rewards, vouchers and customer service)；

These terms and conditions apply to the LOUPE Membership Programme in Hong Kong ("Programme"). It is the responsibility of any person applying to be a member ("Applicant") and each member of the Programme ("Member") to read and understand them.

These terms and conditions must be read in conjunction with any other terms and conditions set out in any Programme handbook and the Programme website ("Website") and other documents as provided by CTF Jewellery Academy Company Limited (operating under the name of LOUPE) and/or its subsidiaries or affiliates (collectively, “LOUPE”) from time to time (together, including these terms and conditions, the "Terms").

By submitting a completed Application Form or otherwise becoming a Member, an Applicant acknowledges that he/she has read, understood and agrees to comply with all of the Terms.

1. Overview of the Programme and general terms and conditions

1.1 The Programme is offered and managed by LOUPE.

1.2 Without limiting LOUPE‘s rights under the Terms, in particular its rights of suspension and termination, Members must comply with all of the Terms in order to maintain their memberships and enjoy the benefits and privileges granted to Members.

1.3 LOUPE reserves the right to amend, supplement or otherwise revise the Terms at any time without any prior notice to Members. In the event of any inconsistencies between the Terms, the terms and conditions as set out on the Website will prevail, unless specifically stated otherwise. Use of the Website is further subject to the legal and privacy terms found on the Website.

1.4 Membership is not transferable and may only be used by the named Member. Misuse of Programme benefits and privileges may result in the suspension or termination of membership or the withdrawal or forfeiture of benefits and privileges (including accrued benefits and rewards).

1.5 Members are required to inform LOUPE of any change in personal particulars as soon as reasonably practicable by emailing enquiry@ loupe.com.hk or such email address as advised by LOUPE from time to time.

1.6 Programme membership and information relating to membership will be kept in LOUPE's records and such records will be conclusive evidence and the sole basis for the calculation and determination of all Member benefits and privileges.

1.7 In the event of any dispute arising out of or relating to the Programme or individual membership, LOUPE reserves the right to make sole and final decisions.

2. Eligibility for membership and applications

2.1 Membership in the Programme is for individual, natural persons only. Joint or duplicate applications, or applications made by or on behalf of any companies, corporations, partnerships, businesses, legal entities or other organizations will not be accepted.

2.2 To apply for membership, the Applicant must complete and sign the Application Form available at LOUPE store at PMQ, 35 Aberdeen Street, Central, Hong Kong or through on-line application at the website of www.loupe.com.hk.

2.3 Members are eligible for enjoying the benefits of the Programme, including but not limited to attending workshops or seminars organized by LOUPE and purchasing goods or services offered by LOUPE.

2.4 LOUPE reserves the right not to consider or process any incomplete or/and incorrect Application Form.

2.5 LOUPE has the sole and final right to approve or reject any membership application regardless of whether an Applicant has met any or all of the criteria for membership.

3. Membership termination and suspension

3.1 LOUPE makes no warranty or representation as to the availability of the Programme or its duration or continuity and may, in its absolute discretion, suspend or terminate the Programme and/or any membership at any time without any liability arising by reason of such action.

3.2 LOUPE may, in its sole discretion, immediately without notice suspend or terminate the membership of any Member who fails to comply with the Terms. Upon the termination of any membership, all benefits and privileges accrued under the membership shall be cancelled and be null and void.

4. Member obligations and warranties

4.1 Members must not:

i) act in any way in breach of the Terms; or

ii) abuse or misuse the Programme, or any of their benefits or privileges offered or gained under the Programme, including: (a) engaging in illegal or fraudulent activities;

(b) supplying or attempting to supply false or misleading information; (c) making

a misrepresentation to LOUPE or any of its subsidiaries or affiliated companies; or (d) selling, assigning or transferring, or offering to sell, assign or transfer, any benefit or privilege of the Programme.

4.2 By submitting an application, each Member and Applicant represents, warrants and undertakes to LOUPE that:

i) the Member or Applicant has provided, or will provide, as and when required by the Terms, to LOUPE all information and details required by the Terms and by LOUPE in its discretion for the purposes of offering and maintaining the Programme;

ii) all information and details provided by the Member or Applicant and held by LOUPE is and will at all times, be correct, complete and current (unless an application is rejected, in which case the obligation to update information and details ceases); and

iii) the Member or Applicant has read, understood, will comply with, and has the power and authority and legal right to agree to, all of the Terms.

5. Liability and warranties

5.1 Except as otherwise expressly provided in the Terms and to the greatest extent permitted by law, LOUPE is not liable (and excludes all liability) for any loss, damages or claims of any kind arising under, pursuant to or in connection with the Programme, including all:

i) direct, special, indirect, consequential, incidental or punitive damages; and

ii) damages for economic loss, loss of profits, loss of revenue, loss of goodwill, loss of bargain or opportunity, loss of anticipated savings or loss or corruption of data, whether in contract, tort (including without limitation negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.

5.2 Subject to section 5.3, any express or implied warranties, representations and statements given or made by LOUPE which relate to the Terms or their subject matter, and which are not specifically contained in the Terms, are excluded and disclaimed to the maximum extent permitted by law.

5.3 Nothing in the Terms excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified. If any condition or warranty is implied into the Terms under any law and cannot be excluded, and LOUPE is able to limit, restrict or modify the Member's remedy for a breach of such a condition or warranty, then LOUPE’s liability for breach of the condition or warranty is limited to the maximum extent permitted by law and LOUPE may, in its discretion, elect between any options available to LOUPE to remedy the breach of such a condition or warranty.

LOUPE will collect, use, disclose or transfer a Members' personal data in accordance with the Privacy Statement published on its website at www.LOUPE.com.hk.

8. Jurisdiction

The Terms are governed by the laws of Hong Kong and each party hereby irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong. 

We at CTF Jewellery Academy Company Limited (operating under the name of Loupe)("Loupe") and our parent, subsidiary and/or affiliated companies within the Loupe group of companies (together the "Affiliates") value your personal data and privacy very highly. We know how important it is to protect your personal data. We pledge to comply with the requirements of all applicable personal data and privacy protection laws and regulations in relation to personal data protection.

Any reference in these terms to "we", "us" and "our" is a reference to Loupe and our Affiliates. Please read this Privacy Statement carefully to understand how we will handle your personal data.

Unless your express consent is required by applicable law, by providing us with your personal data (including by registering for membership of any of our customer or sales and marketing programmes owned, managed and/or controlled by us, registering to attend any of our events, participating in our interactive services or in any way communicating with us), you are accepting the terms of this Privacy Statement and consenting to our collection, retention, disclosure and use of your personal data, including transfer of your personal data overseas, as specified in this Privacy Statement. We do not sell, rent or trade your personal data to or with third parties including our Business Partners. However, your personal data may be disclosed or transferred by us to the third parties described below:

TERMS AND CONDITIONS IN RESPECT OF CLASSES, SEMINARS AND WORKSHOPS (COLLECTIVELY, THE “WORKSHOPS”) ORGANISZED BY CTF JEWELLERY ACADEMY COMPANY LIMITED (OPERATING UNDER THE NMAE OF LOUPE) (“LOUPE”)

1. Enrolment

• Participants / parents/ legal guardian should read these Terms and Conditions before submitting the enrolment form and settling the payment for the Workshops. By enrolling for the Workshops, a participant acknowledges that he/she has read, understood and agrees to comply with all of these Terms and Conditions.
• The enrollment shall take place either physically at the cashier in Loupe at H410, Block B, PMQ, 35 Aberdeen Street, Central, Hong Kong or through on-line application at the website of Loupe at www.loupe.com.hk.
• Participants / parents / legal guardian should enroll for the Workshops on or before the closing date, namely 1 calendar day before the Workshops commencement date. Late applications will not be considered.
• Participants / parents / legal guardian should provide an English name, contact number and e-mail when enrolling online, so that Loupe can contact the participants when necessary.

2. Payment Method

• The Workshops are only confirmed once fees are paid in full.
• Applications are processed on a first-come-first-served basis upon full payment. Acceptance is subject to the discretion of Loupe.
• The successful applicants will be notified of their application result via email. Please check your email accordingly.
• The details of the Workshops as specified in the confirmation email sent to the successful applicants by Loupe shall be regarded as final.

3. No Refunds

No refunds on Workshops fees paid will be made (including absentee or unable to provide related document proof on workshop date, etc.) except in the circumstances when Workshops are full or being cancelled. Participants will be notified for such cases.

4. Non Transferrable

Workshops’ enrolment cannot be exchanged for cash or other gifts.

5. No Exchange

Fees and places of the Workshops cannot be transferred. Only enrolled participants are allowed to attend the Workshops.

6. Points to Note

• Loupe staff may require participants to present their identity documents so as to verify participants' identities. Loupe reserves the right to stop those who fail to prove their identities from attending the Workshops.
• The Workshops description is for reference only.
• Loupe reserves the right to cancel workshops if the number of application falls below the requisite minimum and to change the time and instructor of Workshops should this be necessary.
• No photo taking and video/audio recording is allowed by parents/ legal guardian/participant during the Workshops without the consent of Loupe.
• Loupe is entitled to take photographs of, video-tape or audio-record the  Workshops, and use such photo(s), image(s), audio(s) and video(s) (“Recordings”) in any media or format throughout the world in perpetuity (including but not limited to press releases, print advertisements, posters, leaflets, Facebook page or other social networking sites or web pages for public viewing and downloading, etc.) without the participants’ consents or any payment or consideration to the participants. The Recordings belongs to and is the absolute property of Loupe.

7. Typhoons and Rainstorms

• If Workshops have to be cancelled or rescheduled due to inclement weather, Loupe staff will notify the participant(s) of the arrangements as soon as possible. Generally, if typhoon signal no. 8 or above or red/black rainstorm is hoisted or still hoisted at or after 11:00am, Workshops held at 6:00pm or before on such day will be cancelled.  If typhoon signal no. 8 or above or red/black rainstorm is hoisted or still hoisted at or after 3:00 pm, Workshops held after 6:00 pm on such day will be cancelled.  All the affected Workshops will be postponed or subject to other arrangements as shall be notified by Loupe staff. Apart from the hoisting of typhoon signal no. 8 or above or due to red/black rainstorm, the Workshops will not be affected by other weather conditions.
• Loupe may decide whether to continue the Workshops according to the actual situation.
• The above arrangement is for reference only. In all cases, participants / parents / legal guardian should consider the weather, road and transport situation to decide whether to attend the Workshops. No make-up workshop or refund will be arranged to the absentee for these cases. No make-up Workshops or refund will be arranged for Workshops cancelled due to bad weather.

8. General Terms and Conditions

• Loupe does not make any warranty in respect of any part of this program and disclaims all liability in relation thereto. Participants / parents/ legal guardian shall waive all his or her rights and interest, if any, of any natures to pursue against Loupe.
• Loupe is entitled to suspend, terminate or cancel this program or any part thereof at any time without any prior notice or compensation.
• Loupe has the right to amend any of these terms and conditions without any prior notice.
• Loupe has the absolute right to interpret these terms and conditions. In case of any disputes, the decision of Loupe shall be final and binding on all parties concerned.
• Loupe will collect, use, disclose or transfer the personal data provided by applicants in accordance with the Privacy Statement published on its website at www.loupe.com.hk.
• These Terms and Conditions shall be governed by the laws of Hong Kong Special Administrative Region.
